What is generally not permitted
Direct purchase of agricultural land, plantation property, or a farmhouse in India by an NRI or OCI is generally not permitted under FEMA, regardless of the payment route.
Pathways that exist (case-by-case)
- Inheritance. NRIs/OCIs may inherit agricultural land from a person resident in India.
- Gift from a resident relative in permitted circumstances.
- Resident-family structures. Some families hold plots through resident members. Understand the ownership, succession and trust implications fully, the deed is in the resident’s name, not yours.
- RBI approval routes. Limited, specific-permission routes exist; they are exceptions, not defaults.
